Transparency register converts from a catch-all register to a full register

On 25 June 2021, the Federal Council approved the German Federal Parliament's resolution on the so-called transparency register and Financial Information Act (TraFinG) of 10 June 2021. The TraFinG has come into force on 1 August 2021. This entails far-reaching changes with regard to the transparency register, in particular the obligation of all German companies to report their beneficial owners (almost) without exception. An intentional violation of the reporting obligations under the German Money Laundering Act may result in fines of up to EUR 150,000.00. In the event of serious, repeated or systematic contravention administrative fines can be much higher.

"Claw-Back" Mechanism between Energy, European, and Constitutional Law

Under the 2017 EEG, self-suppliers from highly efficient combined heat and power plants only paid 40 % of the EEG levy for the electricity they consumed themselves in accordance with section 61c I EEG. With the 2021 amendment to the EEG, the legislator has brought back the "claw-back" mechanism in Section 61c II EEG and again significantly restricted the exemption from 3,500 full hours of use - with retroactive effect from 1 January 2019. Those affected must expect substantial additional payments. In their newly published IR article, our colleagues Dr Christos Paraschiakos, Philipp Reinecke and Jonathan Schramm discuss the constitutional permissibility of this retroactive effect, taking into account the provisions of EU state aid law.

After a construction period of 2 years, all rotors of the 32 wind turbines in the municipal offshore wind farm in the North Sea have been turning since 30 June, informs the municipal utility cooperation. The turbines have a total capacity of 200 MW and can thus, in terms of figures, supply around 200,000 households per year.
