First ordinance on the implementation of the Wind Energy at Sea Act
Enacted by the BSH on 15 December 2020
Hot off the press from the Federal Law Gazette: On 15 December 2020, the BSH issued the first ordinance on the implementation of the Wind Energy at Sea Act, thereby establishing the suitability of areas N-3.7, N-3.8 and O-1.3 for use by wind energy in the EEZ. The First Wind Energy at Sea Ordinance (1. WindSeeV) was promulgated this morning in the Federal Law Gazette (see attached).
The determination of suitability is an essential prerequisite for the tendering of areas by the BNetzA. Due to the 1st WindSeeV, areas with an installed capacity of almost one gigawatt (a total of 958 megawatts) can now be put out to tender. According to the FEP, these three areas are to be tendered and auctioned by the BNetzA in 2021.
