Draft Bill on Tenancy Law II

Overview of Amendments

On 29 April 2026 the Federal Cabinet approved the “Tenancy Law II” bill presented by Stefanie Hubig (SPD), Federal Minister of Justice. This bill provides for various changes aimed at strengthening tenant protection. The law has not yet come into force; the bill is currently going through the parliamentary process. 

The aim of the legislative amendment is, in particular, to curb rising rental costs more effectively and to strengthen existing safeguards for tenants. The focus is on capping sharp rises in index-linked rents, as well as on measures designed to prevent the rent cap from being circumvented through short-term or furnished lettings.
