Service charge statement: Tenant's right to inspect payment receipts
On 9 December 2020, the Federal Court of Justice (Bundesgerichtshof) ruled that a tenant is entitled to inspect the payment receipts underlying the service charge statement. The tenant does not have to claim a special interest. The inspection of the payment receipts serves to verify whether the landlord paid the invoice amounts as stated in the invoice and did not benefit somewhat from reductions or discounts. If the landlord refuses the inspection of the relevant payment receipts, the tenant has a temporary right to refuse performance.
